Working visa for the US for 18 months?


My daughter has just got back from working in Summer Camp for 3 months in the US. They have emailed her asking her to work throughout the year for them full time as their office manager for at least 18 months. What are her chances of getting a visa. She obviously has a job to go to, does this make a difference at all. Any info from anyone would be good, I come here for help and you guys always deliver!!!

If they are willing to sponsor the Visa, it will help... US imigration policies vary depending on the nationality of the person in question... what nationality is your daughter?

If the employer can make the argument that it is a position of "special knowledge" (usually requiring a 4 year degree), then they can apply for an H1B. Otherwise it'll have to be an H2B. Both have numerical caps, but the H2B visas go quicker.

My information may be outdated, but check into a J1 training visa. It's inexpensive to apply for, and you don't need a lawyer. It's good for 18 months.

A search for J1 visas online gives lots of links to companies and law firms who will help you apply, so beware of scam artists. The last time I had to deal with a J1, I think it cost less than US$1500, and all our lawyer did was give us an application to an organization that helps process these.

I would assume the camp has legal representation, so they should work through that individual or firm.

It's not too difficult to get a J1, but the big disadvantage is the short 18 month period.

Since your daughter as a job offer already her chances are higher than some of obtaining a visa. Unfortunately this chance is still rather small since the job in question is not a professional or highly skilled job for which there is a shortage of U.S. workers.

Still it is worth a shot.

She would be applying for an H-2B visa which is a temporary work visa unless your daughter holds a bachelor's or higher degree (or equivalent) in the specific specialty for which employment authorization is being sought, if she meets this requirement then she will apply for an H-1B visa.

To do this her employment must be approved in advance by the United States Citizenship and Immigration Services (USCIS) in the United States on the basis of a petition, form I-129H filed by the United States employer.

The employer should know where to obtain and file this form (I-129H).

Once the petition as been approved by the USCIS both the employer and your daughter will receive what is known as a 'notice of action form' (I-797A or B).

With the I-797A or B she can now apply for the H visa and the requirements, fees and procedures are all outlined on the website below.
