Help with Unemployment Claim..Employer is Lying!?


My husband got layed off from his job December 17th. The boss lady got really mad and told him to GO HOME! (Among a couple of other choice words.) So, he did. A co-worker overheard the way he was discharged. He filed for unemployment on the 19th of Dec. Subsequently, his former boss is lying to the unemployment commission saying he QUIT his job and they have denied his claim. We have appealed the denial. So far, they have not contacted the co-worker who overheard the situation. He has not collected anything on his claim. Assuming they are still going to side with his former employer, what is our next course of action?? Can we appeal to the Labor Board in our state??

Get a Lawyer and take the B*tch to court, I had the same thing happen to me. Her name wasn't Theresa by chance was it? I challanged it and lost but she will get hers.

They will tell you if you are denied where to file the next appeal.

Continue to file wait about two to three month and file a claim again, don't give up...

why was he told to go home?
was he told he was fired?
did he show to work his next scheduled shift?
if he was just sent home for discipline and not fired and then did not show for his next shift then he quit, very simple.

after each stage of the claims process they inform you of your rights and how to appeal. follow the steps and start looking for another job.

don't waste money on a lawyer as Mo noted he did and lost
there is most likely nothing to "sue" for.
