CanTexan, I have no problem with NEEDED skilled immigrants, and welcome. I have a problem with flooding markets with above need labor to drive down wages, which I think many are trying to do.

To obtain an H1B classification, the applicant must prove both academic and experience qualifications - and can only apply AFTER the US company has agreed to sponsor them ... by doing their own homework and determining (to the government's satisfaction) that there are no qualified US candidates for the position. As an added point, the H1B is tied to a specific employer AND job function ... a change in either requires a resubmittal of the documentation or at the very least a change-of-status.

The UK version allows skilled workers to enter WITHOUT a job already lined up (i.e. a corporate sponsorship), thereby allowing them to compete directly with UK citizens for all manner of employment.

I *think* there may be some less savory uses of the H1B system in the US; on the other hand, there are definitely instances where there isn't a lot of talent to choose from. I'm one of them ... there's only about a dozen companies worldwide that are in the same business as my employer ... and the worldwide talent pool containing individuals with any amount of experience at all numbers less than 250.

So as the North American workforce ages (and there doesn't appear to be many coming out of the school systems with the right background to take over my specific niche), the companies that are in business try to "poach" from the neighbors ... which is how I ended up in the US. I didn't come looking for the job - it was offered to me.

Its an eerily similar comparison, we are a little earlier in the game (abuse) than the UK but as I see it we are following their lead.

It seems to have worked for the gentlemen above who apparently has one of the jobs that very few in the world are engaged in, but we have all seen the video of the "how not to hire an American" seminars that are apparently a common workshop.

The numbers of graduates in those fields covered by the H-1b are growing steadily but there is still legislation to increase those numbers without proper studies to verify the need or the future turnout of professionals in this country. We need to get a handle on this now so we do not have the same problems as the UK.

NO, to get a H1B visa you need to be sponsored by a US employer first, the process takes a number of months and costs quite a bit. And most importantly they have to prove they are not taking a job away from an American.

Edit* In my personal experience every person I know on a H1B visa has had to have the company prove that the US employer is not taking a job from an American.

How? Following the guidelines a company must publish the job description in national/state newspapers or other relevant magazine or documents for that job field, as well as internally within the company, and on the company website, if job opening are listed on it.
On the note, it MUST state that this is being published for a visa, and the status of visa it is for (ie,green card or H visa). So people applying for that job know why that notice is in that paper/magazine/website.

The US company must then interview any eligible people who applied for the job. And yes in theory this is where the H1B holder can lose their job, if a more suitable person comes along.

If the US companies you know do not follow this practice they are not following the rules and need to change lawyers; as the lawyer should advise the company this is one of the requirements, as you have to provide dates and copies with the application for the visa.

By the way, many visa holders do not realise this process is done and are not inform that it is taking place, as it is classed as standard procedure in many international companies.

I've seen what Skilled immigrants has done to the medical industry and seen the types that do arrive. I've met Doctors from foreign countries and many of them do not cut it as an American doctors. I've notice that alot of those who treat medicare patients are foreign born, and I know that the reason they do so much in medicare, is that they are too incompetent to do other work. THe hospitals are filled with Doctors who are working as nurses and other medical related jobs because they can't cut it as a doctor here. Medical workers who graduated as nurses in their home country come over the US and can not pass the boards and now working as assistant. My Filipino coworkers would tell me how easy it is to buy a college degree and their is an organized system to help the lessor of their peers cheat on the boards. It was so bad that the US suspended accepting nurses from teh Philipines, because a Filipino government official was helping Nurses cheat on the boards. It's horrifying that we are taking in underqualified medical staff becasue we are too afraid to confront mass scale abuses because someone would scream racism. My feeling is that we need to force all professional to be screened to check if they have even the equivalent to a college education and prosecute cheating in board exame and be willing to stand by our bans. I was angry that the Filipino government convinced the US to lift the ban. I am also angry that we accept so many underqualified workers and the American has to work hard to make up for their coworkers inabilites. People keep saying that foreign labor works harder, and I don't see it. THey might put out more physical work, but that's because I see the American trained too busy supervising them. THere was a Filipino nursing supervisor who stated that Americans know more, but she rather hire Filipino nurses because they work harder. Well, we hire professionals for the knowledge more than their physical abilities. If I'm in a hospital, It's nice to have a nurse working hard to make me feel comfortable, but I rather have a nurse that recognize when I'm dieing and to call a doctor.
FOr some of us in the Medical industry, we had a freeze in raises for 5 to 10 years, but the government allow hospitals and the medical industry to continue importing medical workers. I have been telling people not to work in the medical industry. FOr what we do, we are severely underpaid. Only recently nurses have been paid what they deserve, and so is the pharmacist. SOme of the DOctors are paid well, but alot of them are underpaid as well. Some of the medical workers are considered the lowest paid for licensed professionals despite that they are working in hazardous conditions. What males matter worse is that companies hold immigrants workers hostage with their H1B visas. I've seen companies attempt to manipulate immigrants to lie cheat, work extra hours with know pay, cover up abuses because the immigrant workers are afraid that the company would send them home. I was told the reason why Filipino workes are so favored is that in their culture , the boss is king. That what ever the boss says, the workers must do it. I left my job last year, because my boss expected me to do 10 hours work in 8 hours. I keep trying to get my Filipino coworkers to stop working 2 hours for free. Half of the Filipinos were doing it, and I managed to convince the half that was breaking our labor law to stop. The other reason I quit was that I was the only person who didn't get Carpal Tunnel. None of my coworkers complain about having it though.

As for those who are in the ENgiennering industry, India is not that much better. THeir colleges lack accreditation and people can basically buy an engineering degree. THe outsourcing to India in engineering is reversing, because they companies realize that we took all the good engineers already. The reason why they want to bring in the "underqualified" engineers is to lower the payscale of the engineers here.


As for my statemetn, I am not claiming that all Indian and Filipinos are inferior to Americans. THere are some they come from respectable colleges in their home country. On average they are inferior, because they have a third world education and it's a crap shoot when we hire them because of the severe corruption in their country. What I am seeing is that htis country is flooded with unqualified workers, and that is not right.
