Ex Pat Tax Question?


I'm working in Africa tax free but thinking of a move to a job in France, will I still be exempt from paying UK tax, if I don't go home too often?

The answer depends on questions of residence, ordinary residence and domicility. There is an absence of information in the question to provide a single answer.
The permutations are far to numerous to list, so I will make assumptions. If you have left the UK on a contract-based assignment (renewable annually or similar), then you will probably have a number of tickets back to your city of employment or similar 2/3 times per year.
The basic rule for residence is that you must be in the UK for 183 days (excluding days of arrival and departure). If not you are non-resident for that year. If your contract means that for two out of the last three years you are non-resident in the UK for tax purposes, then you are deemed to be not ordinarily resident.
If you are now deemed to be not ordinarily resident for tax purposes, moving to France will not change your status with respect to UK tax.
You must not make visits to the UK which such that the average time spent in the UK in a tax year is 91 days or more(except for visits over which you have no control, such as illness). In practice it is always better for this average to be much less to ensure compliance.
Care needs to be taken to consider residence status upon arrival in France. Double taxation arrangements only apply to UK residents, which would not apply to yourself, since you are not ordinarily resident (based on the assumptions above).
