Wife lives in Canada, offered job in US. They recinded the offer. Legal grounds to sue?



Wife lives in Canada and was offered a job in US with same company. They directed us to handle all the legal issues and cost in writing (email). When paperwork was complete they said corporate would not let them sign it thus the job was gone. We spent $2,500 in legal cost to complete. Her replacement was already hired so out of a job on Sept 1. Can we take to small claims or go to a higher court to reclaim damages, or go higher to get more. Very emotional time for us as I want my wife here as fast as possible (duh) and the immigration process for marriage is too slow!!

Recap the entire situation, factually without any editorializing, to the human resources manager at the corporate level. CC both the HR person at the 2 locations in Canada and US. End the recap with a request that they reimburse her for the out of pocket expenses incurred due to their failure to live up to the agreement.
If you get no response, you can proceed to legal recourse. However, since the aggrieved is Canadian, lives in Canada, and incurred the expenses in Canada, she most likely would not be able to sue in US small Claims courts. I am not sure what the Canadian procedures are, or if there is a $ limit on what you can file for. (There are $ limits in the US, set by state and vary quite a bit).
Small claims does not cover international law, I don't think. It sounds to me in my opinion you might have a case. Try some of the free legal advice websites or ask your local politicans for their recommendations. This can be as easy as email and since they are accountable to the public they usually reply quickly!
Sorry about that. Why would corporate not let them sign... and if the transfer fell through her position should have been retained (or a similar one). It's a hard lesson to learn but never spend your own money at company request.
Employment is at will for both the employee and employer. Your wife's company has the right to let her go at anytime.
