I need some legal advice in Separation/Divorce...?

Hi, I was married for almost 4 years. SInce July, me and my husband have been separated. We are now trying to sort out about our stuff, specially money situation.
The only thing I know is that to apply for the divorce, we have to be separated for 12 months.
Does anybody know my rights in this case? I am not australian (but i have permanent visa) so i dont know exactly the laws.
My husband wants to stay with everything we had....and give me a certain amount of money (half of the value of the total).
I want to know my rights first...I dont want to have anything else than what it is fair in our break up. I am afraid to agree with him and he be in a good situation. I am the one without job beacuse i was studying full time and also no money saved.
Could anybody help me? I just would like to know what are my rights.
I was going to talk with some lawyers about it but i had to leave australia because my mum is sick at the moment...that makes the situation worse.

you have to be separated for a year if you are using separation as grounds for a divorce. family mediation services would help you and your soon to be ex sort out who gets what, and ect. i wouldn't really go for a "lump sum" one off payment for supposedly half of everything. you would end up more worse for wear. I'm getting the impression that pre-nuptial agreements were not signed here... darling.. you marry once for love, and when it doesn't work out, you marry again for the money. ( just kidding, but there is a reason why they say diamonds are a girl's best friend.)

speak with your solicitor, deffinately. Find out which grounds you can petition under, and try to go for the least painfull route. Also, they will be able to help you figure out what you are legally entitled to (alimony, ect) AND the settlement of half all marital assets. (everything bought or obtained during the course of the marriage. this includes all wages earned.) good luck darling... you're in for an uphill battle... marriage is grand, divorce is ten grand. :)

Unless your comfortable with the arrangement drag your feet!

You need to talk to a lawyer and get their advice.
I'm at the tail end of a divorce after 31 years, listen to your lawyer, ok.

Don't agree to anything until you talk to a lawyer. You can get some free advice, check around.
