What issues might you face if the salespeople accept job offers from your firm? |
You are the human resources manager for a large software developer. You have the opportunity to hire three experienced but dissatisfied members of a competitor's sales force. Through informal means, you discover that all three signed nondisclosure agreements with their current employer. You are part of the face of your company, you are in part responsible for taking risks, and spending money because it takes money to make money. If you have even a shadow of a doubt it maybe a conflict of interest, keep looking for candidates, because you can be fired for making a decision too costly for your company. And if they are as "burned" as you say they are, they are out for self right now. I'd stay out of harms way. Perhaps they are hard employees to satisfy and will always complain no matter who they are working for. They also may demand benefits and perks that they say their old company offered, even though it might be a lie. You cannot be responsible for hiring them unless your company has some kind of agreement with theirs. THEY, on the other hand, might have problems if they come to your company - depending on the terms of their contract with their current employer, they could be sued. But that all depends on the laws in your state. In some states, like Georgia, non-compete clauses in employment contracts are not legally enforceable. |
