What can be done when West Virginia CPS fails to follow state code.?

WV State Code 49-6-12 States that an improvement period, for an abusive parent, must be terminated if the parent does not adhere to the rules af said plan.
Both Dept. of Health and Human Resources, and the circuit court judge haveignored this law and have given the mother extended visitation , unsupervised.

Unfortunately, the laws are arbitrarily enforced across the country. In my experience as a former CPS worker and current therapist that contracts with the court, the way the CPS worker reports the parent's progress and compliance with the case plan carries a lot of influence. The strong feelings of the prosecutor may trump the CPS worker's "evidence". When I have a CPS worker that I think is shoving humpty dumpty back together improperly, I regularly go over their head to their supervisor or the DA and let them know my concerns.
