Will Mismatched info on a W2 form get you in hot water?



I recently changed my name legally to get away from a stalker. I was able to change it on my passport, but when I went to change it at the SS office, they couldn't because they had a different date of birth for me. I was told to bring in proof of my date of birth and brought in my birth certificate and passport among other things and was told a change would take place within 3 months. That was 6 months ago! Since then I've gone to the office twice and they keep telling me to be patient. I'm starting a new job soon & of coarse I'll have to fill out a W-2 form. But all my documents have my new name except for SS and SS has a different birthdate that they haven't fixed!! I was really excited about my new job and I'm not sure if I'm even allowed to work until SS changes my name- which they wont do until they fix the year of birth they have on file first...which is still pending no matter what origional documents I've given them. Which date of birth goes on my w2 form when I fill it

You will probably get a tax notice about the discrepancy. Just respond to the IRS about the reason for the difference. You might also include a letter with your return that explains things. There isn't a date of birth on the W-2. You do enter it into the tax program though. DON'T GO TO H&R BLOCK! Use Turbo Tax .

working in payroll, when the employer asks for your SS card for verification, just explain the situation. Tell them you have filed the paperwork to get it changed to your new name. When you fill out the Federal W-4, there is a box on there that asks if your name is different on your SS card, make sure you check that. When you get the new SS card from the SSA, fill out a new W-4 form
Good luck, you will be fine with the W-2 though!!! That is only at the end of the year!!!

Put the data of birth that is on your birth certificate and your new name on the w-2. Keep copies of the name change and the birth certificate in a safe location.

Legally your birthdate and name are on those documents and the IRS will have a hard time faulting you for using those.

Oh, and SS and IRS don't really talk to each other about such things.
