Is it a federal labor law that a employer must pay time and 1/2 aft 40 hrs? |
We live in Phoenix AZ. I am not talking about salary jobs. I am talking about CDL local drivers, assy or manufacturing hourly positions. I hv wked here for 2 yrs and have always received 1 1/2 x over 40 and x2 over 60. My husband has been a CDL driver for 18 yrs in CA. He started working here 5 mths ago for a local frieght comp, requires him to work 11-13 hrs everyday yet pays no overtime. We have been tld by many buss owners this is illegal, other answers this is a right to wk state. Which is it? State or Federal and if illegal whom do you report it to? Time and a half if over 40 hours a week, but some jobs are excluded, and you can be asked to sign a contract saying you will only be paid straight pay. OVER TIME IS A FEDERAL LAW AND YOU LOCAL LABOR BOARD WILL TAKE CARE OF THIS FOR YOU. IF HE IS ENTITLED TO PAY OF ANYKIND THEY WILL MAKE SURE HE GETS IT. AS FOR OVERTIME IT DEPENDS ON WHAT KIND OF A DEAL HW SIGNED WITH THE COMOPANY HE WORKS FOR < EXAMPLE IS HE WORKING BY THE MILE OR TONS OF FREIGHT HE HAULS? OR IS HE A STRAIGHT HOURLEY WORKER.
