Getting out of the Army early for other employment.? |
Hello, before I get a lot of "You chose to serve, it's your fault" answers, please read and try to understand the situation. I signed up for 4 years with the US Army and almost finished. My wife has been having a lot of work done lately with her teeth and our insurance is not covering it. I was recently offered a job that would pay me more money and offers full medical/dental and 401k, but will only be available for a short time. One person in my chain of command says that since I am not reenlisting and I am not needed in our shop for the short time I have left, that if I can prove I have a better employment opportunity, I can get an early release as this is in my best interest. However, someone else in my chain of command is saying that it is illegal for the employer to even offer me a job while I am on active duty. Can anyone shed some light on this before I end up causing myself and my family to get our hopes up? Thank you. You can be offered a job, but you can not be headhunted while on active duty. If you found the jog and pursued it as your time is getting short, there is not conflict. However, getting out early will be entirely up to your present command. I would certainly suggest finding out what you would need to do..more than likely you will need a formal offer from the prospective employer, in writing, that outlines the pay scale, benefits and any other pertinent information, as well as explaining the reason for the time constraint on being able to offer the job to you. I do agree you should check on when your benefits will become active at the new job and find out what full medical and dental is exactly...I have never heard of any insurance that does not have co-pays and yearly caps, especially on dental! its not illegal to offer anyone a job. that is crazy. Seems like you should be able to submit a request through the chain of command and get the right story. yes you can get a discharge if your eoas is short then they can let you go check with your personnal officer The only way I can see this happening is if you have a large amount of leave left and you get terminal leave. I would be wary of the new employer, as benefits usually take anywhere from 30 to 90 days and sometimes longer to take affect. No it is not illegal for someone to offer a service member a job, while they are still on active duty. Unless your word of honor is a piece of s*** to be kept only when convenient, you will serve out your enlistment. |
