Employment law - help!?


The server went down at work as we were unable to use our computers yesterday as our work is 100% computer based. They told us at 2pm to go home - 2 hours early for myself by 6 hours early for others - as it could not be fixed within working hours. Today, our boss has told us to work the time back but we are furious as there was no mention of this yesterday when we were TOLD to go home. I feel if I was given the option I would have stayed at work and twiddled my thumbs instead of working the time back. Can they do this?

You are correct. It is illegal for your employer to ask you to work for extra time now !!

If you are a "non-exempt" employee and are sent home because computers down, power outage, etc. the Company is only required to pay you for the time you actually worked.

The Company has the right to work overtime at anytime, which it sounds as if that is what your boss wants you to do.

The reason companies send people home during an outage is to not have them stay at work twiddling their thumbs.

You are only owned for hours worked.
