Problem with Employment ? |
My employer gave me different job in different department as he offered me in interview. I told my manager in first week but he denied and told me that he could terminate my job because I am in probationary period. First I suspect this is race discrimination and raised a formal complaint but now it has proved that I was offered a different job. Now my employer is saying that this was admin error and now he transferred me to other office in right department. Due to this problem, I went off sick and lost two months wages. I want to recover my wage lose and health damages. As race discrimination is not proved, and difficult to prove in employment tribunal, I just want to know how I can recover my wage lose legally? Either I can take this matter to civil court or not? You could have quit at any time if you didn't like the job they gave you. If you are in the U.S. Good luck. You never stated a claim for which relief is compensible under law. consider yourself lucky to still be employed, if you missed 2 months working for me. I would terminate you and hire someone else. in most states they do whatever they want...do you really want a lawyer? theyre expensive...you might want to just do this job... You have nothing to go on. I think you are under the false assumption that the system is for the worker and you have more rights than you do. Truthfully, if you want to hold on to a specific job....it's the death peals to talk of discrimination and be off sick all in the probationary period. I know of alot of places which would have terminated you very quickly.....you give the impression of a troublemaker in their eyes. Not that anything they did was right. However, it was realistic considering the world today. Didn't your mama tell you there's days like this? Seriously, the world has low values and we have to live in it. So if you look out for yourself...sometimes you have to decide what you ethically will tolerate (and quit) or what you'll do to hold on to the job. But pushing the system is difficult and can kill a job or promotion in a company. While you are on probationary period, you wouldn't have sickleave. The company does not need a reason to dismiss you while you are on the probationary period. It is too bad that you did not do the job that you were given, and THEN, ask when you would have been transferred to the job for which you had applied. |
