My Pregnant Fiance was just Fired from her Work. Do we have a Valid Discrimination Case? Read Below..? |
She was terminated after 9 months of employment and she is now 4 months pregnant. They gave her the reason that she has "taken too much vacation". They have no evidence of her taking more than 3 days of unpaid vacation off during her 9 month tenure there. She has never called in sick or had any other misconduct. Do we have a valid discrimination case? How should we preceed? Thank you so much! That is why this country's value is getting down, right away discrimination's lawsuits, instead of doing your job right, you are after easy money. Not really. She took 3 days of unpaid vacation. Is that against company policy: Was any of it no call no show? Did she always give adequate notice or was it a matter of calling in that day? Does she have an employee handbook? Was she warned? Don't jump to conclusions or any actions before you know the whole story. What does her company policy say about time off or days missed? Did she ever just not show up for work? There are many questions to be asked before you make a rash decision. She needs to contact her employer and talk to them, ask them to see proof of the days she has taken off/missed. This all depends on the code of ethics of the facility. My employer would fire for less, but we sign an at will statement upon hire. Nine months does not qualify as tenure. Most agency do not consider an employee tenured until after ten year of continuous service. Depends on if you live in a "right to work" state??? What was the companies attendence policy? That is the biggest thing. You would have to talk to a lawyer about the discrimination thing. My husbnad is the GM of a local resturant and recently went to court b/c this guy quit, instead of signing a warning paper, saying that he needed to stop flirting with the girls, they were uncomfrotable with some comments or termination will follow. So this guy quits and gets a lawyer and says b/c he was black and the girls working there along with my huband were white they were trying to get rid of him. You can sue for anything. She is a single, pregnant woman. Obviously she has no morals. I wouldn't doubt a lack of work ethic as well. |

You can not do anything about it.. that is the point of a background check. It isn't discrimination, it is the company's right to withdraw the offer of employment based on your background... |
