Can a self-employed person demand an employment contract?


I am thinking of leaving my PAYE job to work from home as an out of hours message pad for international businesses. I will only be working for 1 company but will have to submit a monthly invoice for total time spent on the phone. I do not want to risk leaving my secure job if I'm only earning half what I do now. Can I ask for some kind of 'minimum hours' or 'minimum salary' contract although I will technically be self employed and is it legally enforceable?

Yes you can offer a contract to your prospective clients. In fact, it is better that there is a signed contract between both parties, as it makes everyone's intent clear. You do have to be prepared that they may or may not sign your contract, or they may want to revise it.

If you are self-employed, you have a "contract for services" rather than a service contract. You are a one person business and you can provide your services to anyone you want. The organisation offering you work will be your customer. You can try to renegotiate your contract, but they will probably just drop you. You will have absolutely no job security.

If you want to work on a self-employed basis, make sure you have plenty of potential customers.

the tax man take a VERY dim view on self employed people only working for 1 company, because people used to use it as a tax fiddle - tread very carefully.
