Can one use one's former employer's client list to procure employment? |
My son's employment was terminated due to insufficient French. He was given permission to use his own laptop on company premises and was given access to and he needed to use the company's client databank. He never signed any type of confidentiality agreement(s). Can he use this list to query his former employer's clients offering his own skills as a freelancer? Can he or SHOULD he. Legally he probably can, but will it get the results he wants. He could get a bad rep in the industry. Is it worth it? I say take your talents and get your own clients. I would do it. It doesn't sound illegal. Since your son did not sign any confidentiality agreement and was allowed to use company's data bank, he can certainly use his former employer's clients. I would think an unexpired non-compete agreement would be the only thing that would prevent you, but I am not a lawyer. I only play one on TV. :) |
