Recourse?-Young worker employment threatened?


My 17 yr old sister (turning 18 on 07/24/07) has been working at a temp agency placement for 2.5 mths and the agency now is demanding she has a parent or guardian sign paperwork regarding H&S stating they (the agency) are not liable for any accidents, and that she has taken all required additional training-which she has not been provided with-or she will no longer be able to work through them. When we called the agency anonimously and asked how old you had to be for employment with them, they said 18. The papers they are asking to be signed include verification that the guardian was there during training and has been allowed to read the companies policies on H&S and OHSA, which is false and was never offered. What should she/we do? Is there any type of action we can take against the company-or any action they can direct on us?

Whats wrong with having your parent sign the consent form. In most states you arent considered a legal adult until you are 18. I guess they can do that. If you feel so bothered by them, dont work for them. There are many other temp companies and other jobs that wouldnt require that. And its hard working out there and you can and probably will be fired at some point, dont take it personally, just look for other employment before it gets out of hand. Its a nice choice.. you pick the employer.. dont work for someone whose too difficult to get into the door.. it maybe reflective of whats to come on the job with the company.. nit picking is a sign read it..

The whole issue may be moot after the 24th. Meanwhile, put the ball back in their court. Tell the you would be glad to have a guardian sign, but first they need to provide the training and documentation specified in their request. Put your response in writing. If they comply, sign the papers and move on. If they refuse to provide the training and documents and then release your sister, she may have a case against them.

Don't sign anything. Report them to the state department of labor immediately and start looking for another job. How do they think they can have you sign papers stating they are not liable for workplace accidents? Of course they are liable, haven't they ever heard of worker's compensation laws and OSHA? I got my first job when I was sixteen and my parents never had to sign anything. Same thing for my younger sister and all of my friends who had jobs prior to turning 18. You definitely don't want to sign papers saying that you took training that you never took. The people at this company sound like a bunch of sleazebags. This isn't a company you want to work for anyway. Report them and find a new job. And when you report them ask the department of labor if there is any legal action you can take against them.
