Is it legal for an employer not to have an employees terms and conditions handbook or contract.?

Yes. Employment in the US is at will, so there are no terms or conditions of employment. At will employment means that it is both the will of the employer and the will of the employee for that person to work there, either party can terminate employment at any time for any reason (except for discrimination based on race, nationality, gender, etc) There are some people who have employment contracts (like the military, but that is rare). Some employers will have a handbook of employee guidelines, but that is only for their benefit - its not required.

HUH?

In most of America the handbook is not a contract nor do you have to have a contract to work. Just because a handbook lists vacation does not mean you will get that benefit. Written contracts are optional so there is nothing illegal in the employment situation like I'm answering.

It's not a legal requirement but it is definetely a great way to tell if your are working for a decent company or not. Not to mention you can have written proof of promises made or privilages given to you by the company. It helps take the liability off of each party.
