However, they do not investigate complaints; they can only answer general questions as to whether or not a situation complies with ERISA. In the event of a dispute that cannot be resolved between the covered employee and the employer's Fiduciary, a lawsuit can be filed in Federal Court; state courts lack jurisdictional authority over self-funded ERISA plans. But when a company is self insured, the insurance program is manged by an outside source such as Blue Cross or another HMO or insurance organization. in every government, there's an agency or a department that looks after the welfare of workers in a private firm. they are the ones who impose guidelines on what should be regulated and benefit the workers. also, a union is in place to look after their co-workers need. any infringement made by a corporation is reported to the union, which in turn, files a complaint to the agency or department of the government... |
